eBay Motors $30 million Class Action Lawsuit

What’s this mean to most sellers who were overcharged? Well it means you might be getting back some of your eBay fees. But how much? At the moment, according to eBay’s calculations, which have not been finalized, it is estimated that the refunded amount would be around 6.67% of the Final Value Fees paid (net of any previous refunds). So the more you paid, the more you get back! You have several options if you were a seller effected by this. You can either do nothing and get a check mailed to your registered address, or you can opt out of the settlement and probably sue on your own, or you can object to the settlement.

At the time of this post, this settlement has not yet been approved. The Court will hold a hearing on March 28th, 2011 to determine if this final Settlement will be approved, if it is, expect a check in the mail. This is obviously a huge blow to eBay. Note: This Settlement only applies to eBay Motors – Parts & Accessories Listings, this does not include Store items.

As a former eBay Motors seller, I am happy to see eBay take a major hit like this. Over the years, the fees have gotten so high that it is nearly impossible to break even on eBay. Final Value Fees, listing fees, PayPal fees, etc etc have made selling on eBay less profitable than years passed. To me it feels that the eBay protects its buyers more than it does its sellers. I feel that eBay needs to do more to help sellers be more profitable and offer them more protection against fraudulent buyers as well as idiot buyers who shouldn’t be on eBay in the first place. To me it’s unusual for them to offer so much protection to buyers, when all the money eBay makes comes from sellers and now it looks like they made a bit too much money off them and will be forced to pay them back. Awesome!

Got the email but worried it’s a Scam or Phishing scheme?
Some may be worried that this is a phishing scam, but this case is real and can be found on the US Federal Courts Website pacer.psc.uscourts.gov. Search for the docket case named “Brice Yingling d/b/a Alamo Auto Sports and Andy Scott vs. eBay, Inc.,” Case No. C-09-01733. To view the documents on this site the US Court System charges a $0.04 per page fee. But all the same information is posted on the website listed above. Also, according to the Court’s Order Preliminarily Approving Settlement, you will see that A.B. Data was appointed by Judge Ware to handle the settlement payments and to notify the case members, which is why they set up the website and sent out those emails.

Note: If you did receive this email, it specifically states that your password or account number is not needed to update your address.

    I received one of those checks, for 61 cents….my first inclination was to forward it to the FBI for wire fraud investigation, but seeing that it is actually ” legit” I have to add : it is not even worth to use as toilet paper, the check is from Chase bank, and the bastards charge you five dollars to cash the check, so instead of cashing $0.61 I would end paying the thieves at chase 4.39 dollars for the privilege of stepping on their rats nest.

    What kind of retard thought of that?

    My total judgement was $2.06, but after legal fees I got a check for $0.14
