eBay Motors $30 million Class Action Lawsuit

What’s this mean to most sellers who were overcharged? Well it means you might be getting back some of your eBay fees. But how much? At the moment, according to eBay’s calculations, which have not been finalized, it is estimated that the refunded amount would be around 6.67% of the Final Value Fees paid (net of any previous refunds). So the more you paid, the more you get back! You have several options if you were a seller effected by this. You can either do nothing and get a check mailed to your registered address, or you can opt out of the settlement and probably sue on your own, or you can object to the settlement.

At the time of this post, this settlement has not yet been approved. The Court will hold a hearing on March 28th, 2011 to determine if this final Settlement will be approved, if it is, expect a check in the mail. This is obviously a huge blow to eBay. Note: This Settlement only applies to eBay Motors – Parts & Accessories Listings, this does not include Store items.

Power Balance Arena???

The maker of Power Balance sports wristbands has reached a tentative agreement to take over naming rights at Arco Arena. A sources say Power Balance LLC has made a tentative agreement for a five-year deal. Arco’s agreement runs out after the end of the NBA season, ending a 25-year relationship. Its departure leaves the Maloof family, which owns the team and the building, searching for a replacement in a down economy.

Spokesmen for the Kings and Power Balance had no comment on the deal, which was originally reported by the Sactown Royalty fan Web site.

Power Balance, based in Laguna Niguel, is a $35 million-a-year maker of trendy silicone wristbands worn by such athletes as Lamar Odom of the Los Angeles Lakers and soccer star David Beckham. The company has run into some controversy; its Australian website recently posted a statement saying there’s no “credible scientific evidence” supporting the company’s claims about the health effects of the wristbands.

Word on the street is Power Balance will be adding new holographic stickers to building for improved strength, balance and flexibility during eathquakes. Unfortunitily “there is no credible scientific evidence that supports the claims” that this will work.

Porsche 918 RSR, the 767 hp hybrid

This ain’t your average tree hugger hybrid!!! Take a look at Porsche’s 918 RSR, which just rolled onto the company’s stage at the 2011 North American International Auto Show. It has a 563hp traditional gasoline engine mounted amidships, with a pair of electric motors powering the front wheels that bring the total power up to a whopping 767. The electric motors are not powered by a set of batteries, as in a traditional hybrid, rather they take their power from an inertial flywheel mounted where the passenger seat would be on a road car and spinning at up to 36,000rpm. That’s spun up by momentum when the car brakes and, when the driver hits a button, that momentum is converted to give an acceleratory boost.

That’s the same setup as the 911 GT3 RSR Hybrid, which ran reasonably successful last year. Its styling is obviously an extension of the 918 Spyder, with a number of cues taken from the incredibly successful Porsche 917 racer of the early ’70’s. At this point Porsche hasn’t indicated when this car will make its debut on the track, nor in which classes it will run, but one thing’s for clear: this isn’t for the road. So, we’re a bit disappointed we still haven’t any firm details on a production, street 918 — not that we could afford it anyway.

Iphone on Verizon

Verizon Wireless is set to unveil the much-anticipated Apple iPhone 4 on its network on Tuesday in New York City, according to several reports.  The phone will eventually hit all Verizon stores by the end of January, reports The Wall Street Journal, citing a person familiar with the matter.

It is the first time the iPhone will be available in the US on a network other than AT&T, but smaller telcos like Sprint Nextel and T-Mobile are still without the popular smartphone. The Verizon phone, long the subject of speculation and hearsay, will be “similar to the iPhone 4 but run on the carrier’s CDMA technology”, reports the Journal.

The availability of the iPhone on another carrier could sell millions of new devices to ensure Apple’s “strong momentum” and stall the growth of devices running Google’s Android operating system, according to The New York Times.  “It will significantly shift the power again toward Apple,” an analyst told the Times. “Apple will significantly blunt the growth of Android.”

For AT&T, however, the forecasts aren’t as rosy. iPhone users on its network have complained about poor service and dropped calls on the network, and Consumer Reports last month ranked AT&T the “worst-rated” carrier. Verizon came in second in the survey.

Paul Reynolds, an editor at Consumer Reports, said at the time that a Verizon iPhone “could indeed be good news for iPhone fans”.   Analysts told the Journal that AT&T could see one to three million fewer subscribers because of the Verizon offering.

UFC 126 – Silva vs Belfort

UFC 126 from the Mandalay Bay Events Center in Las Vegas, Nevada on February 5, 2011 will headline two dynamic strikers in the middleweight division. 

Current champion, Anderson “The Spider” Silva, will put his 12 consecutive victories in the UFC on the line against fellow Brazilian, “The Phenom” Vitor Belfort.  This explosive match up has been destined for fruition since Belfort’s return to the UFC in 2009. 

On February 5th, either the current champion Anderson Silva will remain the No. 1 middleweight in the world. Or, a new champion will reign supreme and history will be rewritten in Las Vegas as Vitor Belfort dethrones “The Spider” and becomes the UFC middleweight champion.

Russell Brand thinks his wife, Katy Perry, is pretty without any makeup on, but that doesn’t mean she likes having pictures of her, without any on, posted up on Twitter.

E! Online reports that they think the unflattering picture of Katy Perry was posted on her husband’s Twitter page as a prank over the holiday weekend. Perry obviously wasn’t laughing though, as the picture was pulled down off the social site quite quickly.

OK! Magazine claims that Katy Perry came out and said that she suffers from a lack of body confidence.

She reportedly said, “It’s been pretty difficult, because I have to be pretty every single day. But I think my curves are something to be proud of.”

Power Balance Really Power Scam

Around the world people are saying .”OMG! So this necklace and wrist band does really have holographic powers?!?! NO WAY!” well Folks “YES WAY, it’s all a scam.”  Who’s are our credible source you ask. None other than the the makers of the necklaces and bracelets themselves.

Here’s their statement:

In our advertising we stated that Power Balance wristbands improved your strength, balance and flexibility.

We admit that there is no credible scientific evidence that supports our claims and therefore we engaged in misleading conduct in breach of s52 of the Trade Practices Act 1974.

If you feel you have been misled by our promotions, we wish to unreservedly apologies and offer a full refund.

OK, so people around the world probably are not really saying that. (but I will bet you at least a few are).  The fact that this is a scam is not really news to anyone, but the fact that a regulatory authority has made them admit that their claims are a simply a fraud is a surprising first.  Bravo to the Aussies I say.

It’s back, the C-Class Coupe!!!

Set to launch next year, the 2012 C-Class Coupe has shed some of its camo, and has even given up its interior secrets. The C-Class Coupe will feature a revised interior that will also surface in the updated version of the C-Class sedan.

The C-Class Coupe will be developed and produced at the Bremen plant, on the same assembly line as three existing models.

Mercedes stopped short of releasing specifics on the C-Class Coupe, stopping simply at confirming a 2011 introduction and the whereabouts of its origin. The current C-Class offering price from $33,600 in the U.S., and start with a base 3.0-liter 228 horsepower V6 with a rear-wheel drive platform. The C-Class also offers a 268 horsepower 3.5-liter V6, but commands a $6,000 premium for its 40 horsepower improvement.

We expect the same aforementioned drivetrains to be offered on the C-Class Coupe at its introduction, with a future AMG model like that of the existing C63 AMG Sedan – starting at $57,350 and powered by a 451 horsepower 6.3-liter V8 – a possibility. Although an AMG variant is almost certainly in the cards for the C-Class Coupe, everybody anticipates a switch to a smaller 5.5-liter V8, coupled with twin-turbochargers as Mercedes moves towards smaller, more fuel efficient engines.

Mercedes’ Bremen plant, where the C-Class Coupe will be produced in 2011, is a massive facility that operates a flexible assembly line, which currently produces the C-Class Saloon, C-Class Estate and GLK. Starting with the 2011, Mercedes will add the C-Class Coupe to the same assembly line.

“The decision by the Board of Management to produce the Coupé version of the current C-Class here in Bremen as well represents another important milestone on our way to becoming Mercedes’ competence centre for the C-Class and is a clear sign of the trust in the Bremen team’s capabilities and standards,” says Peter Schabert, head of Mercedes-Benz’ Bremen plant.

UFC 125 – Edgar vs. Maynard Tie

For five minutes, Gray Maynard looked like the best 155-pound fighter in the world, but he could not extinguish the considerable fire housed within UFC lightweight champion Frankie Edgar.

Some say there was little “Resolution” in UFC 125 as Edgar retained his title in a hotly contested draw with Maynard on Saturday at the MGM Grand Garden Arena in Las Vegas, weathering a first round in which he was brutalized by nearly 100 power punches from the challenger. Two judges scored it 48-46, one for Maynard and another for Edgar. A third saw it a 47-47 deadlock.

“It was a great fight,” Edgar said. “Gray came in hard. S—, I don’t know.”

That Edgar reached Round 2 was a monumental feat in itself. Clocked by a ringing left hook a little more than a minute into the match, he was on his heels for the remainder of the first round. Maynard appeared close to finishing it on a number of occasions, as he waylaid the champion with a relentless volley of punches, highlighted by a pair of wicked right uppercuts. Miraculously, Edgar stayed alive, even as he teetered on the brink. When asked what he remembered about the first five minutes, he replied, “Not much.”

Maynard’s pace slowed noticeably in the second round, and Edgar crept back into the fight. His speed, footwork and quick combinations returned, along with a powerful slam that wowed the Sin City crowd. The back-and-forth encounter spilled into round three, as Maynard answered with power punches and a pair of takedowns of his own.

Edgar secured two takedowns in the fourth and threatened his challenger with a standing guillotine choke against the cage. Maynard escaped and pushed the fight into the final round. There, Edgar utilized a variety of strikes — combinations, jabs and knees to the head and body — to keep Maynard guessing and the 155-pound belt around his waist. They traded blows at the end of it, providing a fitting finish to a memorable rematch.

“Felt good,” Edgar said. “Felt like the first round didn’t happen. It was a close fight. What are you going to do?”

Maynard, still unbeaten as a professional, did not feel the draw did his performance justice.

“I kind of punched myself out in the first [round], so [in] round two, I couldn’t really go that hard,” he said. “But I thought I won one, three and five. Five was a close one, but I think I pushed the pace, and I thought I won. That’s what I thought. I thought it was a 10-8 [first round] and then me in the third and me in the fifth.”
